1. Services

ZamZam XP ("we," "us," "our") provides adventure tourism services including trekking, paragliding, and surfing experiences in Nepal and Morocco. By booking with us, you agree to these Terms of Service.

What We Provide

• Professional guides and instructors
• Accommodation as specified in itineraries
• Safety equipment and permits
• Meals as indicated in package descriptions
• Ground transportation as part of the adventure

What's Not Included

• International flights
• Travel insurance (required but arranged by participant)
• Personal expenses
• Visas and entry permits to countries
• Items marked as "not included" in specific packages

2. Bookings & Payments

How to Book

Bookings can be made via WhatsApp, email, or through our website. A booking is confirmed only when:

• We receive your booking request
• We confirm availability
• You pay the required deposit
• You receive written confirmation from us

Payment Terms

• Deposit: 30% of total cost required to secure booking
• Balance: Due 30 days before adventure start date
• Late Bookings: Full payment required if booking within 30 days of start date
• Methods: Bank transfer, credit card, or agreed payment platforms

3. Cancellations & Refunds

Cancellation by Participant

If you cancel your booking:

• 60+ days before: Full refund minus 10% administration fee
• 30-59 days before: 50% refund
• 15-29 days before: 25% refund
• Less than 15 days: No refund

Cancellation by ZamZam XP

We reserve the right to cancel adventures due to insufficient bookings, weather, safety concerns, or force majeure. In such cases, you receive:

• Full refund of all payments made, or
• Option to transfer to alternative dates/adventures

Weather & Conditions

Mountain weather and ocean conditions are unpredictable. While we don't cancel for minor weather, safety always comes first. We'll work with you to adjust itineraries when possible.

4. Liability & Insurance

Travel Insurance Requirement

You must have comprehensive travel insurance covering:

• Medical expenses and emergency evacuation
• Trip cancellation/interruption
• Personal accident
• Lost/stolen belongings

For trekking above 4,000m or adventure sports, ensure your policy covers these activities.

Our Liability

We maintain professional liability insurance and operate with certified guides using proper equipment. However, adventure activities carry inherent risks. You acknowledge:

• You participate voluntarily at your own risk
• We're not liable for injuries from inherent adventure activity risks
• We're not responsible for third-party service failures
• We're not liable for delays, losses, or expenses from force majeure events

Health & Fitness

You confirm that:

• You're physically and mentally fit for your chosen adventure
• You've disclosed any medical conditions that might affect participation
• You've consulted a physician if uncertain about fitness requirements
• You'll follow guide instructions regarding safety and health

5. Participant Conduct

We expect participants to:

• Follow guide instructions for safety and group welfare
• Respect local cultures, customs, and environments
• Not endanger themselves or others through reckless behavior
• Not be under the influence of alcohol or drugs during activities
• Treat guides, staff, and fellow participants with respect

We reserve the right to remove participants who violate these expectations, without refund.

6. Disputes

Problem Resolution

If issues arise during your adventure:

1. Inform your guide or our staff immediately
2. We'll work to resolve the issue on-site when possible
3. Document the problem if immediate resolution isn't achievable
4. Contact us formally within 14 days of adventure completion

Governing Law

These terms are governed by the laws of Nepal. Disputes will be handled through:

1. Direct negotiation
2. Mediation (if negotiation fails)
3. Legal proceedings in Kathmandu, Nepal (as last resort)
